Arizona Medical Marijuana Laws

Over the past two decades medical marijuana laws have been changing rapidly throughout the United States. As of 2019, a total of 33 states have approved marijuana in a medical or recreational use. With these states the District of Columbia, US Virgin Islands, Puerto Rico, and Guam have also approved programs. Currently 11 states and the District of Columbia are fully legalized; however, crossing state lines can have serious consequences on you even in fully legalized states. In the state of Arizona, Proposition 203 was passed in 2010 for the use of medical marijuana by Arizona voters. Since then the Arizona Medical Marijuana Act (AMMA) has been regulated by the Arizona Department of Health Services (ADHS). The AMMA act allows seriously ill patients to be treated with medical marijuana, and also protects patients from prosecution under their doctor’s recommendation to receive a medical marijuana card.

Under Proposition 203, a patient is able to receive a medical marijuana card if they have at least one qualifying condition. With a medical marijuana card a patient is allowed an allotment of 2.5 ounces every two weeks. Patients are also allowed to possess 2.5 ounces without being detained with a valid card; however, carrying less is always better! Arizona is known to have some of the hardest criminal marijuana laws in the United States for those who are not registered patients. Be smart about carrying medical marijuana on yourself – even with your card!

Arizona has one of the strictest driving under the influence (DUI) policies in the United States. To be safe and protect yourself don’t drive under the influence! If police suspect you are under the influence they have the right to take a blood test. However, refusing to take the blood test the can lead to worse penalties, such as losing a license. When passing through federal land such as monuments, national parks, national forests, and federal properties it is important to remember that possession of cannabis, even with a card, is illegal. Being caught on federal land with medical marijuana can is punishable by up to a year in jail and a hefty fine. After multiple offenses this punishment continues to rise. It is also important to remember that even on the ski slopes cannabis is illegal. The actual slope is considered federal land, but the base may be private. Be sure that if you are carrying flower or a CCELL cartridge and battery on you to be aware of federal vs private/public land.

In August of 2019, Arizona passed a new law that a medical marijuana card is valid for two years from its registration date after August 27, 2019. The new law allows patients safer medicine and new patient registration that will only cost half of the price. In the future the ADHS hopes to get rid of the cards and create an electronic medical marijuana card. Although this isn’t guaranteed yet a plan is being developed to help eliminate a wait time.
